We recognise that people who access and/or use the awonhub.com gamified sustainability website (“awonhub.com”, or the “Website”), and the services (“Service”) therein, (collectively, the “Website and Service”), operated and provided by Awon Hub Pty Ltd (“Awon Hub”, “the Company”, “us”, “our”, or “we”) value their privacy.  

We are committed to the protection of our members’ personal data, and we will only use your personal information when it is necessary for us to deliver a service or perform other necessary functions and activities required for the operations of the Website and Service. 

We provide this Privacy Policy to explain how we process personal data about you to help you make an informed choice about whether to use or continue using the Website and Service. Unless stated otherwise, this Privacy Policy applies to the Website and Service and all data collected from you.

This Privacy Policy provides important information regarding:

  3. to whom we disclose your data, and

We reserve the right to and may periodically update, modify, adjust, or revise the terms of this Privacy Policy from time to time, and we will notify you by posting a new version on Website and Service. You agree to regularly review these terms that may be updated from time to time. Your continued use of the Website and Service after the effective date will be subject to the new version of Privacy Policy, and constitutes your acceptance of how we will collect, handle, and use your personal data according to the revised Privacy Policy. 

This Privacy Policy is incorporated into, forms part of, and is subject to the “Terms of Service for All Users” document. Any terms not defined herein but defined in the ‘Terms of Service for All Users’ document shall have the meaning ascribed thereto in the ‘Terms of Service for All Users’ document. 

1.      THE DATA COLLECTED FROM YOU AND THE WAYS WE COLLECT YOUR DATA

1.1.   Data Provided by You.

When You use our Website and Service, You may directly provide certain personally identifiable information to us, such as:

  1. Registered user name and password
  2. Contact information (such as your name, personal identification number or driver’s license number, date of birth, age, postal or e-mail address, telephone numbers) and other information used to verify your identity for account registration purposes
  3. Account and Profile information (such as Account I.D., Nickname, gender, profile photo and/or avatars. Please be reminded that such information may be disclosed to other users in connection with the use of the Website and Service and may also be made available to your connections or the public on third party services.) 
  4. Personal content preferences
  5. Messages to the Website and Service (such as your support tickets, chat logs, written or verbal communications with us, content you created and posted, etc.)
  6. Billing and financial information. We use secure payment platforms, such as Stripe, to process online orders all in a ‘secure socket layer’ environment. We do not store any credit card information or other financial information you provide to us to process any transactions on our web server. Please be reminded that when you use any payment service provider and/or third-party payment platforms for the payment of any purchases on our Website and Service, you are subject to the privacy policy of the relevant payment service providers and/or third-party platforms.   7. Transactional data, which includes information about individual purchases and/or subscriptions, payment information, product details, account notes recorded in connection with your transactions with us or other questions or issues and other information you provide to us in connection with a transaction, and transaction history.
  8. Other data that you voluntarily provide (such as information to register for a competition, when you apply to be an Awon Hub Affiliate Referrer and/or Awon Hub Mentor, participate in surveys, feedback you provide to us, or data to identify a lost account).

1.2.   Data collected automatically.

We may use cookies, web beacons, and/or other similar technologies when you access and/or use the Website and Service. Cookies are small text files stored by browser(s) on your desktop computer or mobile device. Most web browsers automatically accept cookies, but you can usually modify browser setting to decline cookies. If you choose to decline cookies, you may not be able to access certain parts of the Website and Service and may experience technical problems receiving current information from the cookie-disabled services. The use of cookies and/or other similar technologies is to identify and remember you as a registered user, identify your browsers, and to collect data from your device such as:

When you access the Website and Service through any third-party services such as social networking sites (e.g., Facebook, Google, WeChat,) or from any mobile devices, you allow us access to certain information stored on these third-party services or mobile devices such as:

  1. Demographic data (e.g., determination of your IP address);
  2. Data related to security and loss prevention, and/or to fight against fraud; 
  3. Data associated with your device (e.g., computer or mobile device type, technological information, unique device identifiers, country);
  4. Data to do advertising, marketing and analysis to improve our Website and Service.

2. THE REASONS WHY WE COLLECT YOUR DATA

2.1.   To Provide the Website and Service

In order to provide you with the Website and Service, we collect and process data necessary to

  1. Create and maintain User Accounts and operate the Website and Service;
  2. Administer your membership and allow you to access and use the Website and Service and participate in the Sustainability Quests and gameplay;
  3. Provide and deliver products and services that you request;
  4. Enhance the safety and security of our products and services;
  5. Verify and confirm payments;
  6. Send updates, notifications, and service-related communications, to you.

2.2    To improve and optimize the Website and Service and product offerings to Users

To provide better services to you, we need to collect and process necessary data to

  1. Manage, maintain, and update your Account and manage the relationship with you;
  2. Provide social and platform features to you;
  3. Enable you to communicate with other users;
  4. Respond to your comments and questions and provide support to you, and send related information (e.g., updates, support messages, security alerts) to you;
  5. Plan, allocate resources, evaluate and report current policies, track potential problems, bugs, and/or issues with the Website and Service; and to develop new and/or improve policies and features to update and improve the Website and Service, to enable you and other users to have a better experience;
  6. Provide products and services and special offers and promotions in the Website and Service. 

2.3.   To secure the Website and Service

To enable us to take appropriate security and technical measures to protect your information from unauthorized access, loss and misuse, to keep the Website and Service and features therein safe and fair, we collect and process necessary data: 

  1. for legal, security and safety reasons and loss prevention measures; 
  2. to detect, investigate, and prevent cheating, fraud, crime, fraudulent transactions, and other illegal activities, and protect the rights, and interest of our registered users and protect users from harm;
  3. for analysing and monitoring the use of the Website and Service and its social features by users, to monitor and moderate chats;
  4. to carry out our legal obligations, and to comply with applicable laws, regulations, and legal processes, and to pass your information to agencies or organizations in charge of crime and fraud prevention & repression when we are legally required to by legal authorities or courts.

Please be reminded that we cannot guarantee the absolute security of your personal data, nor can we ensure the security of any of the communication facilities provided by us on the Website and Service. Please note that any personally identifiable information or personally sensitive data, such as financial information, that you communicate or disclose to any user in connection with the Website and Service may be collected and used by others. As such, we highly recommend that you exercise extra caution and wisdom when disclosing and sharing any information, especially personal information, online and/or through the Website and Service to any user. Please also be reminded that any questions and answers, submissions, comments, and replies to other users, that you post in the quests, forum, and public chat areas will be publicly available.

With your consent, we may process personal data for any additional purposes described to you at the time the information is collected. 

3.      TO WHOM WE DISCLOSE YOUR DATA

3.1.   Our Service Providers

We share personal data with companies that perform services for us (such as web hosting, information technology, payment processing, product fulfilment, marketing, email distribution, insurance, audit, accountancy, legal and advisory services), or otherwise assist us in performing services we provide to you and other users.  We share personal data with employees, officers, agents, affiliates, suppliers, or subcontractors, as reasonably necessary, to provide customer service and resolve complaints, identify, investigate, and prevent fraudulent transactions, communicate with you, provide emergency notices and/or updates, design and execute our marketing campaigns, administer our promotions and advertising services, and/or deliver products and services to you. Please note that since some of these service providers are located abroad, certain disclosures imply a transfer of your personal data outside of Australia, as described in Section 4.

3.2.   Other Users

As social features are a core element of our Website and Service, other users may see your profile data, in-game activities, and read the content and messages you have posted. Any user who receives any information including personally identifiable information, from another user shall not disclose or use such information, except where expressly permitted by that user or except where such information has ceased to be of a confidential nature. In any event, we shall not be liable for any unauthorized disclosure or use by another user or other person of any content. We advise you take extra caution and avoid sharing and disclosing any personal information or sensitive data online at any time. 

3.3.   Third-party Suppliers

We work with third-party suppliers who help us to maintain the Website and Service, and provide and improve our products and services to you and all users of the Website and Service. We will not sell any of your personal data to anyone. We will share relevant personal data that is necessary for the third party to deliver the product or service to you. We share personal data with businesses that we partner with to provide you with certain products and services, such as those offered in the rewards catalogue or sponsored prizes for certain quests or competitions, that we may organise from time to time. We are not responsible for any additional information you provide directly to these third parties. Since these third-party partners may access your data that you provide to them directly and they operate under their own privacy policy, we strongly encourage you to review and become familiar with their privacy and security practices and policies before disclosing additional personal data to them. 

3.4.   Public authorities, legal and law enforcement organisations 

We may release personally identifiable information and/or non-personally-identifiable information to public law enforcement authorities if required to do so by law, or in the good faith belief that such action is necessary to comply with all and any applicable laws, or where it is pursuant to or we are required to respond to a governmental, regulatory, administrative or court order or directive, a subpoena or a search warrant, or to combat fraud and illegal activity.

We also reserve the right to disclose personally identifiable information and/or non-personally-identifiable information that we believe, in good faith, is appropriate or necessary to enforce the Agreement, take precautions against liability, to investigate and defend against any third-party claims or allegations, to assist government authorities and enforcement agencies, to protect the security or integrity of the Website and Service, and to protect the copyrights, trademarks, other legal rights, property, or personal safety of ourselves, our users, or others.  

4.      INTERNATIONAL DATA TRANSFERS

In order to provide our Website and Service, to operate our Website and Service worldwide, and to make them available to you, your information may be transferred to countries/regions outside of your residence, or may be stored or processed in these countries/regions. Regardless of where our Website and Service is located, we will take reasonable steps to protect your data in accordance with the provisions of this Privacy Policy. By accepting this Privacy Policy, you understand and agree that your data may be collected, stored, used in any country and/or transferred to any country in the world. 

5.      DATA RETENTION AND STORAGE

We will retain and store your data while your account is active or while we are providing you with services, unless a request from you to delete such data is received. In the case you request to delete your account, remove or delete your personal data, we will retain your data only for as long as there is a reasonable legal basis to do so, such as to comply with our legal obligations, resolve disputes, and/or enforce the agreement between us. We will only retain your personal data for as long as is necessary to fulfil the purposes for which such data was collected and processed, unless a longer retention and storage period is required under applicable law. After that, your personal data will be deleted or anonymized, as provided by applicable law.To free up our server storage, we reserve the right to purge all inactive and deactivated accounts and associated data with such accounts as and where necessary. 

6.      DATA SECURITY

We have endeavoured to take reasonable physical, managerial, and technical safeguards to protect personal data from misuse, interference and loss, and from unauthorised access, modification, or disclosure. Please be aware that transmission of information via the Internet is unfortunately not completely secure, and there are always risks of hacking and cyber-attacks on the Internet. We cannot ensure or warrant the security of any information you disclose on, through or within the Website and Service and you do so entirely at your own risk. We cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. If we learn of a security systems breach, we may post a notice on the Website and Service or attempt to notify you by email so that you can take appropriate protective measures. You, and all users, are solely responsible for maintaining the confidentiality of your account passwords and are fully responsible for all activities that occur under your account and password. Please be aware that websites with links to and/or from our Website and Service, such as third-party links inserted in posts by other users, may collect personal data about you and this Privacy Policy does not apply to, and cannot control the activities of those third-parties.  We highly recommend that you exercise caution and read the privacy policy of such third-part websites you may be directed to before providing any personal data.

7.      THE OPTIONS YOU HAVE ABOUT YOUR PERSONAL DATA

7.1.   Access the personal data we hold about you

You have the right to access to, or a copy of, the personal data we process about you, and to correct your personal data. Where we hold personal information about you, if you request in writing, we will provide you with a copy to the information on request in an electronic format after passing our review process, within a reasonable time, if it is reasonable and practicable to do so. If the request affects the rights and freedoms of other or is manifestly unfounded or excessive, we reserve the right to charge reasonable administrative fees (taking into account the administrative costs arising therefrom) or refuse to act on the request. 

7.2.   Right of Rectification

You have the right to correct or supplement inaccurate or incomplete personal data we process about you. You may also access and update some of the personal information you have provided to us on your ‘Profile’ page after you login to your account. There is no fee for correcting your personal information under your ‘Profile’ page.

7.3.   Other Rights

You also have the right to have your personal data deleted, object how we use or share your personal data, and restrict how we use or share your personal data. You can opt out of or withdraw your consent to receiving marketing or promotional communications from us. Please note that if you delete certain personal data, certain features and functions offered in our Website and Service may be changed or no longer accessible or available to you. Also, please note that even if you have deleted personal data from our Website and Service or deactivated your account, copies of your personal data, such as your public posts, may be retained on search engines, or by other third parties, or other users who have accessed and/or shared your posts outside of our Website and Service.

If you have questions about data protection, or any requests for resolving issues with your personal data, we encourage you to primarily contact us through the Website and Service support email so we can reply to you more quickly. We will respond to all requests within a reasonable time frame.

8.      AGE LIMITS

You confirm that you are an adult or older in your country of residence (or at other age in your jurisdiction where you are classified as a majority) when using the Website and Service. If you are a minor child or under the legal age of majority (“Minor” or “Child”), please do not send any data about yourself to us, including your name, email address, or telephone number. We strongly urge all parents to supervise and instruct their children to protect that personal data and never disclose personal data without the prior permission of parents. If we learn that we have collected personal data about a Child, we will delete that data as soon as possible. Also, if you believe that we might have any data from or about a Child, please contact us, so that we may take the necessary actions.

9.      MERGER, ACQUISITION, SALE OR INSOLVENCY

In the event that we are acquired by or merged with another entity, we reserve the right, in any of these circumstances, to transfer the information or assign our rights to the information that we have collected from our Users as part of such merger, acquisition, sale, or other change of control.

In the event of our insolvency, reorganization, receivership, winding-up or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your personal information is treated, transferred, or used.
